Network Management Policy

BEK Communications, (BEK) commits to the open and non-discriminatory use of the Internet by its customers and commits to use reasonable network management practices to ensure an open Internet. BEK will manage its network and provide access in accordance with the Federal Communications Commission’s (FCC) Open Internet Rules (adopted December 21, 2010 in 25 FCC Rcd 17905) and in compliance with any future rules adopted by the FCC.


BEK shall make available public information on its website regarding its network management practices, performance and commercial terms of its service sufficient for consumers to make an informed choice regarding their use of such services. BEK will not unjustly or unreasonably prevent or interfere with competition among Content, Applications, Service or Device Providers.

Network Security and Congestion Management

BEK uses generally accepted technical measures to provide service levels consistent with product descriptions, to all customers, such as application-neutral bandwidth allocation, as well as measures to address service attacks, illegal content and other harmful activities to protect network integrity and reliability.

BEK reserves the right to prioritize traffic based on real time and non-real time applications during heavy congestion periods based on generally accepted technical measures. BEK may apply speed thresholds on the amount of data you as a customer can upload and download within stated time periods. If you exceed these thresholds, BEK may temporarily limit the speed at which you can send and receive data over the BEK access network. BEK may use other traffic management and prioritization tools to help ensure equitable access to the BEK network for all customers.

BEK monitors customer usage to efficiently manage the performance of the network to ensure a sustainable quality broadband service is provided. Peak network usage is between 4:00 and 11:00 p.m. Monday through Friday and 10:00 a.m. and 11:00 p.m. on Saturday and Sunday. During peak usage times, priority may be given to applications such as browsing, email, streaming, instant messaging and gaming.

Congestion due to malfunctioning hardware and/or software will be remedied as quickly as network engineers can diagnose and identify the offending hardware/software.

Congestion due to malice will be remedied using any technique available, including protocol-aware filtering and rate-limiting, to control and limit the offending source. BEK may seek criminal charges against those who inflict network malice. BEK may also attempt to recover costs incurred from network malice.

It is not acceptable to use the BEK network for any purpose that violates local, state or federal laws or to transmit communications that might be highly offensive or damaging to any recipients or to use the service in a manner that is unintended. It is not acceptable to interfere with, violate, circumvent, misuse, distribute or disrupt network users, equipment or services, which include but are not limited to:

  • Attempting to obtain unauthorized access to any network or account. This includes accessing data not intended for end user customers, logging into a server or account without being expressly authorized to access or probing the security of other networks.
  • Attempts to interfere with the Service of others including users, hosts and networks. This includes “denial of service” attacks, “flooding” of networks, deliberate attempts to overload a Service, introduction of “Trojans” and attempts to “crash” any host.
  • Reselling any BEK Internet Services, without BEK’s written consent.
  • Distribution of BEK Internet Services beyond the scope of your end-user account.
  • Equipment, accessory, apparatus, circuit or devices that are harmful to the network, shall not be attached to or connected with BEK facilities.
  • Circumventing copyright laws and regulation, including the unauthorized download of music, video, images, books, software or content and/or other copyright protected works.

BEK provides Spam filtering with each customer’s email address. Details of this service are listed on BEK’s website. BEK will not ask you for your password in an unsolicited telephone call or email. If you believe your password has been compromised, you should immediately change your password to prevent the unauthorized use of it.

BEK also offers protection against the evolving PC threat landscape with managed virus and spyware protection, anti-phishing protection and personal firewalls. A deep packet inspection technology is applied to the primary Internet peering points to defend against worms, popups and other active web based threats.

Device Attachment Rules/Application Specific Behaviors

Except as may be provided elsewhere herein, BEK does not currently engage in any application-specific behaviors nor does it employ device attachment rules for its network. Customers may use any lawful applications or devices with BEK.


BEK shall not unjustly or unreasonably block access to lawful content, applications, services or non-harmful devices, subject to reasonable network management.


BEK shall not unreasonably discriminate in transmitting lawful network traffic over a consumer’s broadband Internet access service, subject to reasonable network management practices.

Network Performance

BEK makes every effort to support advertised speeds for the Average Surfer and Advance Surfer offerings and will dispatch repair technicians at BEK’s discretion to customer sites to troubleshoot and resolve internet speed performance caused by BEK’s network. Basic Surfer offering speeds are maximum speed allowed and will vary considerably based on the actual plant serving the premise. BEK measures availability, latency, and aggregate utilization on the network and strives to meet internal service level targets. However, customer’s service performance may also be affected by one or more of the following: (1) the particular websites being accessed; (2) capacity in the public Internet beyond BEK’s network; (3) customer’s computer and equipment (including wireless router); and (4) inside wiring at customer’s premise.

BEK tests each service when installed to demonstrate that the service is capable of supporting the advertised speed. Customers can also test their actual speeds using the speed test found on the company website.

Internet Packages and performance

BEK’s new Internet package speeds include:

  • 6M/512K (Cooperative area) - Basic Surfer: Internet speeds are severely limited.
    • Commercially reasonable efforts to achieve up to 6M/512K, based on age of plant, distance and access technology. This product has no speed commitment and Internet access specifically managed to maintain limited access to customers of this product. Great for basic emailing, web surfing, instant messaging and Facebooking. It is NOT recommended for any real-time services like voice, video, VPN or FTP applications and Internet speed is unpredictable.
  • 12M/1M (Cooperative area) - Average Surfer: Internet speeds are unrestricted.
    • It's acceptable for video chatting, streaming video (YouTube), online gaming, multiple online gaming, audio chat, streaming audio, FTP and most work-from-home applications.
  • 20M/3M (Cooperative area), 20M/2M (Rural Bismarck area) - Advanced Surfer: Internet speeds are unrestricted.
    • It is also ideal for small to medium-sized businesses (15 or less seats) and heavy home use. Great for more advanced work-from-home applications, multiple office connections (VPN's), work-from-home sending information to other locations, video streaming, IP voice, Netflix, streaming HD video and online surveillance.
  • 30M/3M (Rural Bismarck area) and 40M/4M (Cooperative and Rural Bismarck areas) - Faster than Fast Surfer: Internet speeds are unrestricted.
    • This package is great for home users who need the biggest, best and fastest. Or for medium-sized businesses (15 or more seats).
